TERMS AND CONDITIONS
HEIDI SHANNON will herein be referred to as HS AND HUMPAN POTENTIAL REFERRED TO AS HPU.
Booking Conditions & Disclaimer
This booking agreement is legally binding and is acknowledged by a digital signature when commencing your online booking form on the HS OR HPU website. You acknowledge by digitally entering a booking form on our website that you agree and are legally bound to the below agreement. This agreement ensures the health and safety of all retreat, course or coaching attendees, affiliates and contractors to HS OR HPU.
This agreement provides a fair and professional workspace to commence your retreat or program and outlines the terms of your booking, the behaviour that is expected from you and what HS delivers based on the packages you have viewed on our website or that have been emailed to you.
This agreement is between ‘you’ the retreat, coaching or course attendee and ‘we’ HEIDI SHANNON AND HUMAN POTENTIAL UNLIMITED.

Packages & Prices
Live prices are always available and up to date on our website. You must view and agree to a program quote/proposal or up to date package prior to processing your booking and you acknowledge when booking that you agree to up to date packages. We often run specials and promotions and these are available on the day of promotion and not to those who have booked the same program before or after.
Once you have agreed to the coaching or retreat proposal - the full amount is charged in increments or up front (defined in your proposal). Regardless of circumstances you are liable for the full amount to be paid. Incremental payments are taken each week or month - depending on what is defined in your proposal.
Prior Notice/Booking Requests
We require more than 48 hours notice to create or give you access to our program/s and to notify our team. We reserve the right to reject or cancel a booking request if we believe that our program is not right for your individual scenario or if we are unable to fulfil your requests. If your program request is urgent please contact us immediately before booking online.
Missing or rescheduling sessions is strongly discouraged. Please remember that not
completing, or partially completing your assignments is not a reason to reschedule. If assignments are not complete, it is very important that we work together during your scheduled session to strategise, overcome obstacles, and establish next steps.
If I am not given 24 hours notice before cancelation you will be charged for the
session. Unless there is a valid excuse or emergency.
Confidentiality: This coaching relationship, as well as all information (documented
or verbal) that the Client shares with the Coach as part of this relationship, is bound
to confidentiality by the ICF Code of Ethics but is not considered a legally confidential
relationship (like in Medicine or Law). The Coach agrees not to disclose any
information pertaining to the Client without the Client’s written consent. The
Coach will not disclose the Client’s name as a reference without the Client’s consent.
The Client agrees that the Coach may use Client name, contact information on forms
related to credentialing as proof of session. Likewise, the Client agrees not to disclose
any information pertaining to the Coach without the Coach’s written consent; and the
Client will not disclose the Coach’s name as a reference without the Coach’s consent.
Confidential information does not include information that: (a) was in the Coach’s
possession prior to its being furnished by the Client; (b) is generally known to the
public or in the Client’s industry; (c) is obtained
by the Coach from a third party, without breach of any obligation to the Client; (d) is
independently developed by the Coach without use of or reference to the Client’s
confidential information; or (e) that the Coach is required by law to disclose.
Additionally, sessions conducted and/or recorded via Skype or other VOIP technology
are not to be shared with anyone other than Client and Coach without permission of
Coach Disclaimer of Liability: Client hereby employs a Coach for the purpose of
supporting the Client with respect to Client’s self-awareness, vision and goals, and
strategic plans, has experience in such matters and agrees to render such coaching
services. Client understands and agrees that she/he is not an employment agent,
financial analyst, psychotherapist or business manager. I have not promised, shall not
be obligated to, and will not 1) procure or attempt to procure employment, business
or sales for the client 2) act as a therapist, providing psychological counselling,
psychoanalysis or behavioural therapy.
Concierge Services & Personal Assistance
The Role of HS & HPU
Your retreat facilitator & retreat host offer the following services and complete this role in the allotted time slot each day that is quoted for. If you require extra time with this/these person/s for further assistance, you must request this directly with the HS/HPU office via email for an adjusted quote. They offer you:
® well being advice and assistance
® management of your team & program
® liaison with accommodation management to ensure the highest quality setting for your experience (please note accommodation is not managed or owned by HS OR HPU, if situations arise that are out of direct control in regards to property maintenance we cannot be held responsible)
® liaison between yourself and ES/HPU office
The HS office offers the following services:
® management of your schedule and team
® management of your accommodation and liaison with accommodation management (only when booked by ES/HPU)
® travel arrangements with our driver or shuttle if booked by ES/HPU
® booking and management of therapies and adventure activities if booked by ES/HPU
What your facilitator and the HS/HPU office does NOT offer or allow before, during and after your retreat experience:
® out of hours phone calls
® text messages or emails that are inappropriate and non professional
® excessive contact with your facilitator, any team member or the ES/HPU office
® personal shopping for goods or toiletries that are not already supplied in your room (we cannot supply medication of any kind).
® personal assistant type roles (phone calls, emails, research, contacting family or friends on your behalf).
® extensive facilitation and booking time that is excessive and an abuse of our services.
We provide a nurturing and safe environment and our program is thoughtfully planned, but no responsibility can be taken for any injuries incurred during the retreat by HS. You agree to our damages and health disclaimer when filling out your health form prior to attending retreat. HS and all subsidiaries will incur no responsibility for any injury physical or emotional that you incur whilst in our care. Please use your own personal judgment when considering the advice of our health professionals and consult your own health providers when required. When you complete your health information we require you to agree to a health consent and liability disclaimer agreement. Without this agreement we cannot offer you our services.
It is common on retreat for some to experience ill side effects to a cleanse or detox or being away from home in a foreign country including head ache, body ache, nausea, digestive upset, lethargy, emotional changes and more. Every body is unique in how they handle a cleanse and change of environment as we all have different levels of tolerance. ES assists in managing these symptoms naturally and by slowing down the ‘healing crises’ by slowing down the detox. We are not comfortable and do not recommend any form of extreme detox including fasting.
Health Consent & Health Disclaimer
When agreeing to these booking conditions you are agreeing to the following statements:
I am seeking to consult ES and its holistic health practitioners in their capacity to aid me in a finding a balanced approach to health and wellness and understand that ES offers a special interest in nutritional, holistic, alternative and environmental medicine.
You understand that:
1. This means that we offer a more holistic approach to patient diagnosis and care with an approach primarily involving diet, natural supplementation, exercise, lifestyle and stress management & support, therapy and understanding to help you reach your goals. I understand that ES/HPU does not offer a main stream medically supported health and wellness process.
2. That HS/HPU charges an agreed upon rate for retreats prior to starting the retreat and I understand and agree to this rate.
4. That HS/HPU may offer some of the recommended products for purchase including supplements and educational materials but I understand that I am not obliged at any time to purchase unless I feel that it is for my best interest.
5. I understand that if I request extra therapies during my retreat program that my designated credit card will be charged for these at the time and an HS/HPU team member will notify me of these charges before purchasing.
6. Some of the treatment suggestions (e.g. nutritional or digestive supplements) offered by HS/HPU are considered to be outside the parameters of conventional medicine in the Western World. Some of our treatments fall under the category of complementary or alternative medicine. These interventions are in the majority of cases are supported by well researched evidence based on the findings of reputable scientists, neurologists, GP's, nutritionists, Naturopaths and many more reputable and qualified health professionals and are only prescribed with utmost care based on our own findings of what is helpful in helping you recover your physical, mental and emotional health. I understand that I am to use my best judgement on what is right for me and for me only.
7. I am attending HS/HPU of my own free will and consent and as an informed adult taking responsibility for my own health and my own actions exercise my right to discuss and choose any useful and suitable treatment(s) made available to me.
8. I verify that all of the information in my correspondence (by phone, email, booking and health forms) is true and correct to the best of my knowledge. I also understand that if I have withheld vital information that this can be detrimental to my health and the health of others attending the program. I vow to be truthful, open and honest in my communication with all HS/HPU Professionals.
9. I understand that I am fully responsible for my own health and that I will/do not now or in the future hold HS/HPU responsible for any injury or loss that results from attending a retreat. I understand that I am responsible at all times for making the right decisions for my own health.
We each are responsible for our own experience. …
We endeavour with passion and expertise to provide you with a personalised program that enables you to reach your individual goals. However we offer no guarantee that you will achieve your individual goals or experience your individual desires within a short time frame; some skills may take some of us weeks and others a lifetime…. Our personal objectives can only be reached over time and with effort and may or may not be reached within your stay with us. We cannot guarantee that you will feel a certain way within a certain time though you can be assured that we do everything in our power to help you reach your goals. Be assured that we will always do our best to ensure that you receive your specified treatments in accordance with your specified needs and offer you full support on your journey to health and wellness. Taking responsibility for your health and your actions will give you the best possible opportunity to make the most of an outstanding experience.
Personal health and client history forms are to be completed before each retreat/program thoroughly so that we can treat your circumstances and issues with diligence. These forms must be completed by the person attending retreat. A retreat cannot begin without this vital information and all forms are required 48 hours before your retreat start. We also advise you to consult your health carer if you have any pre-existing medical conditions and ensure that our treatment is suitable for you and that you do so prior to booking. It is imperative that you offer us a full outline of the issues you wish to confront and move past during your retreat stay including ALL health and emotional/mental health history. If information is withheld and your treatment is deemed insufficient than ES/HPU cannot be held responsible. We require personal and health information so that your team can be chosen to suit your specific needs and to ensure that we are properly equipped to take excellent care of you.
Credit card details will be required as a bond for any damages to accommodation on your behalf during your stay and security deposits are the responsibility of the client if required. By agreeing to our terms and conditions, you allow us to process payments on your chosen credit card for costs incurred by you within your accommodation whilst attending your retreat. All costs will be outlined and forward to you in the form of a written invoice and payment receipts will be provided. At all times ES/HPU will communicate to you clearly any extra charges that you request at the time of request.
Smoking & Alcohol
Our retreat is a smoke free environment. You are welcome to smoke outside the grounds.
Alcohol is not available on our menu or on retreat but is available at nearby restaurants.
Every person attending retreat has gone to great lengths to be able to take the time out of their busy lives to enjoy a retreat. Each person attending retreat is their first and foremost for their own journey, inward reflection and time to reassess their life.
We do not tolerate any distraction to the program or to other people’s programs. Please focus on yourself and your own journey.

Failure of retreat cost and payment post completing your booking form will result in serious and immediate legal action being taken against you. The costs of legal action will also be your responsibility and will be charged to you.
Why Our Payment / Non Cancellation Terms Are Strict
We are not a resort. We are a small business offering specific and highly valuable health care to unique individuals. Unfortunately if a situation arises where you cannot attend retreat for any reason, we cannot refund or transfer your booking. We apologise for not being able to offer a more compassionate booking policy. Regardless of circumstances, our running costs are paid in advance (your accommodation, food, chef, wellness team, therapy, travel, extensive booking time and coordination etc.) and all payments are non refundable & non transferable. To continue our operation as a small business in the health industry and to continue to be able to help others, employ a world class team and lease world class facilities our retreat costs are paid well in advance and to continue to be able to pay those costs we cannot refund or transfer your booking.
Private Health Insurance
No part of our program is covered by private health insurance that you may have in your own country of residence.
Fit & Well To Travel
It is a condition of this booking that you are fit and well to travel at the time of booking and travel.
It is a condition of your booking that you have international travel insurance. Proof of this is required before program start.
In case of accident or emergency (e.g. you injure yourself or become ill whilst staying at our venue) Alive can recommend local hospitals or doctors to assist. We will also notify your family. Please note we do not offer a support service to clients outside our retreat.
Payment Via Somebody As A Gift
It is common for family members, companies or friends to offer payment for a retreat as a gift or loan. Regardless of the agreement between the paying person and the retreat attendee, if these are the payment details we are provided with, these are the payment details that we withhold and process for all retreat costs and costs incurred during retreat and this person is responsible for all quoted retreat costs, incurred costs during retreat and damage to property. If you are the paying person, we require a written email/text message of consent with the booking form to confirm your agreement to these terms and future payments. As the paying person please note that you are responsible for all payments in relation to the client you are paying for.
The retreat attendee agrees to all booking and retreat conditions and the paying person. The retreat attendee acts on behalf of the paying person and the paying person when supplying their credit card details agrees to these conditions. We reserve the right to process any payments quoted and incurred during retreat without prior notice to the credit card holder. It is the responsibility of the retreat attendee to ensure that the paying person understands and agrees to these conditions before offering their details.
Cancellation Of Your Program By ES/HPU
We reserve the right to cancel your retreat before or after the retreat start date if the following occurs:
® Extreme anger;
® Damage to property;
® Distraction to others programs;
® An unwillingness to commit to or continue the program;
® Evidence or if we suspect heavy use of illicit drugs immediately prior or during your program;
® Any consumption of alcohol or any mind/behaviour altering substance;
® Disrespect to any staff member or affiliate of ES/HPU;
® Failed payment;
® Not providing us with accurate information about your personal situation;
® & anything else we deem to be unlawful or damaging circumstances.
If your program is cancelled due to the above it is a condition of your booking that you understand that no refund will be offered.
If the client chooses to vacate or cancel a retreat setting prior to end of the retreat, they do so of their own free will and understand that no refund will be offered.
Cancellation of The Retreat Program By ES/HPU
We reserve the right to cancel a retreat program due to any unforeseeable circumstances that are out of our direct control and inhibit us from delivering the promised program at the stated date. If this ever occurs ES/HPU will offer another suitable date, close to the original date or transfer your booking. This can include core team (retreat facilitators who are irreplaceable in their roles) illness or family emergencies, natural disasters and any other reason we deem to be appropriate. ES will advise you immediately of any such changes. ES will always work with you to find the best possible solution if such circumstances should ever happen.
ES holds all information in relation to a client 100% private and confidential. If you require it, a confidentiality/NDA agreement may be organised prior to the beginning of your stay with us. At your discretion, therapists may & can share personal information with each other to ensure that you receive the correct treatment. If you do not wish for clients to share personal information, please advise prior to retreat start.
Agreeing to our Terms
By you the attendee signing a retreat quote or recognising via a web form that you have viewed and understood these conditions you immediately agree to these booking conditions and confirm your retreat attendance and these conditions outlined in this quotation are legally binding. By booking via our web form you understand that you are entering a legally binding agreement. Breaking this condition of booking could or will result in legal action being taken against you. The cost of any legal action will be your responsibility and charged to you.
